Swire and Sons furnished the necessary returns and gave on undertaking that the men would be maintained and controlled until they left the United Kingdom in the course of the present month, in fulfillment of the purpose for which they were brought here.

In view of the steps actually taken by your Agents when the matter was explained to them, the Secretary of State has decided not to institute criminal proceedings for the offences which were comitted by the Laster against the Aliens Act; but he will be glad to have an assurance, the matter has been brought to your notice, that you will at once take steps to secure that there shall be no similar occurrence in the future. It must be clearly understood that foreign seamen brought here in this way for employment as crews of other vessels are passengers within the meaning of the Aliens Act, even though they may be placed on the articles of the ship that brings them and are in the pay of its owners; and as passengers they are subject to the requirements of the Act in regard to returns, inspection and leave to land. If these requirements are not complied with a prosecution must
ensue.
